Deferred Action for Childhood Arrivals (DACA) Open January 20, 2021 – Fact Sheet

What is DACA?

On June 15, 2012, the secretary of Homeland Security announced that certain people who came to the United States as children and meet several guidelines may request consideration of deferred action for a period of two years, subject to renewal. They are also eligible for work authorization. Deferred action is a use of prosecutorial discretion to defer removal action against an individual for a certain period. The Trump administration ended DACA, but through litigation, it was required to remain open to those who already had DACA in order to renew status. There were no new applicants for DACA allowed until 2021.

What does it mean that the program is reopened?

The government is reopening the program in 2 phases. First, they will allow for the cases, which were in process in 2017 to be reopened (by the resettlement organization and parents). Second, they will open the process for new applicants.
